Tegen digitale sloten in Enschede

Stel je voor dat je een huis huurt en je huisbaas op een dag komt vertellen dat je vanaf volgende maand je huis niet meer met een sleutel kunt betreden. Hij heeft iets veel innovatievers gevonden: je kunt je huis voortaan alleen nog in via de speciale app op je smartphone. Oh ja, en de digitale sloten gaan ook vastleggen wanneer je thuiskomt en weggaat.

Dit is het bericht dat alle ~2400 bewoners op de campus van de Universiteit Twente ontvingen op 4 december 2025. De studenten waren ‘not amused’. Ze zetten een petitie op, kregen media-aandacht en woonden een vergadering bij van de Centrale Huurdersraad Drienerlo om deze plannen van de woningcorporatie te bespreken. Volt-gemeenteraadslid Erik Kemp was uitgenodigd om achtergrondinformatie te geven over de voor- en nadelen van deze digitale sloten, vanuit zijn expertise op het gebied van privacy en cybersecurity en zijn rol in de lokale politiek. Na afloop van de bijeenkomst steunden alle aanwezigen het initiatief van Erik om ook in zijn rol als gemeenteraadslid een discussie over digitale sloten aan te gaan.

Onze belangrijkste argumenten tegen deze digitale sloten

We onderscheiden twee hoofdargumenten tegen deze digitale sloten: 

1. Het zou niet verplicht moeten zijn voor iedereen die een huis huurt dat je alleen met een smartphone je huis in kunt.
2. Je huis binnenkomen of verlaten mag geen datapunt zijn en je moet kunnen weten dat dit niet gebeurt.

Tijdlijn

4 december 2024: Veste Wonen verstuurt hun eerste e-mailbericht waarin digitale sloten worden aangekondigd.

18 december 2024: - UToday - 'Sleutelpoort op campus: bewoners willen geen digitale sloten'. - Security.nl - 'De woningstichting wil de voordeursloten vervangen door een app, Mag dat?'.

13 februari 2025: Veste Wonen stuurt een nieuwe e-mail:
> 1. Huurders krijgen de keuze uit een sleutelhanger, de digitale sleutel in de Veste Wonen-app, of beide.
> 2. Vanwege zorgen van een groep huurders over privacy en data hebben we de leverancier gevraagd geen informatie over het openen en sluiten van het slot te registreren. Deze gegevens worden niet opgeslagen.
> 3. We voeren het nieuwe sluitsysteem stap voor stap in. We beginnen deze zomer met de nieuwe gebouwen aan de Boulevard en de short-staykamers op de campus. Op basis van een tussentijdse evaluatie worden dan de vervolgstappen bepaald. De Centrale Huurdersraad blijft nauw betrokken.

Waar zijn digitale sloten al ingevoerd?

Voor Nederland heeft ons Kamerlid Marieke Koekkoek de minister gevraagd of er een volledig of gedeeltelijk overzicht is van huizen of gebouwen in Nederland waar digitale sleutels nodig zijn om huizen te betreden, dan wel waar het betreden of verlaten van een huis digitaal wordt geregistreerd, en zo ja, of deze lijst met het Parlement kan worden gedeeld.

Uit eigen bron hebben we gehoord dat dit systeem mogelijk in gebruik is in Nijmegen, Groningen, Utrecht en Amsterdam.

Wat personen kunnen doen

In Duitsland is het gebruikelijk om een nieuw slot te plaatsen als je ergens intrekt, en het oude slot terug te plaatsen als je weer verhuist; dat wordt aangemoedigd. In Nederland is dit ongebruikelijk, maar je zou het kunnen overwegen als je om wat voor reden dan ook geen digitaal slot wilt.

Juridische procedures en bestaande jurisdictie

Voor zover wij weten, is er in Nederland nog geen juridische procedure geweest tegen digitale sloten. Wel vonden we deze juridische procedure uit Finland (zie ook dit artikel over die Finse juridische procedure op Security.nl), waar de Finse toezichthouder voor gegevensbescherming de Nederlandse privacy-activist Michiel Jonker, die de juridische procedure startte, in het gelijk stelde. 

Enkele punten uit die procedure:
1. Het voorgestelde systeem in Finland zou in strijd zijn met de GDPR.
2. Een verhuurder kan geen toestemming geven voor de verwerking van persoonsgegevens namens een huurder.
3. Een gegeven toestemming om persoonsgegevens te verwerken moet te allen tijde herroepen kunnen worden.
4. De vereniging van eigenaren had ten onrechte geen alternatieven onderzocht die de privacy niet of in mindere mate schenden.
5. Geen enkel digitaal slot kan inbraak voorkomen als de inbreker het huis niet binnenkomt met een sleutel.

Digital Locks

Imagine you are renting a house, and one day the landlord comes in and tells you that from next month, you will not be able to enter your house with a key any more. They have found something much more innovative. You will (only) be able to enter your house with your smartphone, where you must have their app installed. Oh yes, and the digital locks will also be logging when you enter and leave your house.

That's the message that all ~2400 residents on the campus of the University of Twente received on 4 December 2025. The students were not amused. They set up a petition, got media attention, and they attended a meeting of the Central Tenants Council Drienerlo to discuss these plans of the housing corporation. Volt city councillor Erik Kemp was invited to give some background information on the pros and cons of these digital locks, based on his expertise in privacy and cybersecurity and his role in local politics. After the meeting, all attendees supported Erik's initiative to also start a discussion on digital locks in his role as a city councillor.

Our main arguments against these digital locks

We identify two main arguments against these digital locks: 1. It should not be compulsory for anyone renting a house that you can only enter your house with a smartphone. 2. Entering or leaving your house should not be not be a data point, and you should be able to know that that is not happening.

2025-02-13: Veste Wonen sends a new e-mail: > 1. Tenants will have the choice of a key tag, the digital key in the Veste Wonen app, or both. > 2. Due to concerns from a group of tenants regarding privacy and data, we have asked the supplier not to log information regarding the opening and closing of the lock. None of that data will be stored. > 3. We will introduce the new locking system step by step. We will start this summer with the new buildings on the Boulevard and the short-stay rooms on campus. Based on an interim evaluation, the future steps will be determined. The Central Tenants' Council will remain closely involved.

Where are digital locks already implemented?

For the Netherlands, our MP Marieke Koekkoek has asked the minister whether they have a full or partial overview of houses or buildings in the Netherlands where digital keys are necessary to enter houses or where entering or leaving a house is digitally registered, and if yes, whether this list can be shared with Parliament.

From our own sources, we have heard that this system might be in use in Nijmegen, Groningen, Utrecht and Amsterdam.

Things individuals can do

In Germany, the first thing you do when moving into a place is changing the lock to your own – and to change it back before moving out. That is encouraged. In the Netherlands, this is unusual, but this is something you might want to consider if for any reason you really don't want the digital lock.

Legal procedures and existing jurisdiction

As far as we know, there has not been a legal procedure against digital locks in the Netherlands. We did find this legal procedure from Finland (see also this article on that Finnish legal procedure on Security.nl), where the Finnish Data Protection Supervisor ruled in favour of Dutch privacy-activist Michiel Jonker that started the legal procedure. Some points from that procedure: 1. The proposed system in Finland would violate the GDPR. 2. A landlord cannot consent to the processing of personal data on behalf of a tenant. 3. A given consent to process personal data must be revocable at any time. 4. The association of owners had wrongly failed to examine alternatives that do not infringe privacy or do so to a lesser extent. 5. No single digital lock can prevent burglary if the intruder is not entering the house with a key.
